Judge sets trial in Brooke Skylar Richardson's baby death case for next year

LEBANON, Ohio (AP) — The Ohio trial of a former high school cheerleader charged with killing and burying her newborn baby is now scheduled for next year.

A judge has set a tentative date of Sept. 3 for 19-year-old Brooke Skylar Richardson's trial.

Prosecutors say Richardson buried her baby in 2017 shortly after giving birth in the southwestern Ohio village of Carlisle. She's pleaded not guilty to charges including aggravated murder.

Defense attorney Charles H. Rittgers says the tentative trial date likely would change if Ohio's Supreme Court decides to hear a defense appeal involving testimony by doctors.

The defense wants the high court to hear their appeal of a court ruling that prosecutors can present testimony from an obstetrics-gynecology practice's medical staff. The defense argues that testimony shouldn't be allowed, citing physician-patient privilege.
