Food licenses for NKY cafe reinstated; owner still facing criminal charges

DRY RIDGE, Ky. — The Northern Kentucky Health Department has reinstated the food licenses for Beans Cafe and Bakery in Dry Ridge and Hebron, according to the restaurant owner's attorney.

NKY Health had stripped Beans of its licenses after its dining room remained open in defiance of Gov. Andy Beshear's order prohibiting indoor dining for three weeks amid rising COVID-19 cases.

“Do what is best for you and your family and your situation,” said owner Richard Hayhoe when the order went into effect last month. “Please, Frankfort, you don’t need to tell everybody what they must and must not do.”

Hayhoe still faces charges of operating a restaurant without a permit in Grant and Boone counties.

"The criminal charges remain pending against the owner, and we will do what we need to do to defend his rights for a favorable outcome," according to Hayhoe's attorney, Chris Wiest.

Wiest told WCPO last week that he will demand a jury trial for his client to "see what the community thinks about these charges." Wiest said Hayhoe will likely not be arraigned until February.
