CINCINNATI – Special counsel assigned to investigate illegal voting allegations brought against Hamilton County Prosecutor Joe Deters found no evidence to support those claims.
Montgomery County Chief Assistant Prosecuting Attorney Mary Montgomery delivered her finding to Judge Steven E. Martin and recommended no charges be filed.
Tim Burke, chair of the Democratic Party in Hamilton County, made the allegations on December 2, 2013. Deters ran for office as a Republican.

Burke accused Deters of voting and running for office under false addresses in 2012 and 2013. Burke based his allegations on Melissa Hendon Deters’ divorce petition, dated Nov. 22, stating Deters moved out of the couple’s Symmes Township home on July 8, 2012.

Deters used that address on his filing papers and voter registration.
In responding to the result of the special investigation’s findings, Deters said Burke’s allegations were politically motivated.
“I was always in compliance with the law,” Deters said. “This was simply a political stunt by Tim Burke. It was an incredible waste of time and money.”
