CINCINNATI - The Banks has dropped its lawsuit filed against Toby Keith's I love this Bar and Grill on Tuesday.
The Banks' development team of Carter and The Dawson Company originally filed suit in February against Toby Keith's for $121,000 in back rent.
"We're pleased that we could settle this before the suit moved any further," said Scott Stringer, executive vice president at Carter. "We continue to look forward to creating more opportunities for people to live, work and play at our last retail spot in Phase 1. There is much more to come for The Banks."
When The Banks filed its initial lawsuit, a Toby Keith's attorney, Gregory McClure stated the rent was placed in escrow until the landlord resolved a leasing issue. Toby Keith's owners viewed the opening of the Tin Roof at the Banks in September as a violation of a lease clause promising Banks' developers would not recruit competing venues to the Cincinnati riverfront.
In a press release issued by The Banks, no further detail was given as to how the dispute was resolved. Toby Keith's never closed in the months since the suit was filed.
