Parents take Hamilton City School District to federal court for allegedly not investigating bullying

HAMILTON, Ohio - A Hamilton family is suing the Hamilton City School District in federal court for allegedly ignoring bullying at an elementary school.

The lawsuit filed by Walter and Lisa Baker alleges "severe harassment at the Bridgeport Elementary School" took place while the Bakers' son was in the third and fourth grades. The Bakers says their son had to change schools as a result of the harassment.

The federal lawsuit contends the principal of the school never conducted an investigation into the bullying allegations despite assuring the family one would be undertaken.

The Hamilton City School District policy manual states an investigation will be performed whenever a bullying complaint is received. Involved parties are given an opportunity to submit evidence and a list of witnesses to aid in an investigation.

The Bakers allege the harassment began in September 2009 and continued until he left the school in December 2010.

A spokesperson for the school district told 9 News, "On the advice of our counsel, we do not comment regarding litigation matters."
