The victim was asked over and over again if he was gay...when he finally said he was...the trash assaulted him. THIS is what makes is different from another assault. I can't believe there are idiots that still believe being gay is a choice. Small minded fools that live in a little conservative bubble.

This is a simple assualt case, nothing else. People these days think if someone accidently steps on there heals that it is a hate crime, give me a break.

Just like the law that the citizen's of Cincinnati shot down!! Come on, why should a sexual preference, get preferential treatment?? Minorities don't have a choice of black & white, but you choose to be gay!! It doesn't mean you get special treatment!! My family helped found Cincinnati, but does that mean I deserve special treatment?

to moosetangs "Nobody goes into a bar, or any establisment, harrassing some one who is gay, they dont know."..do you remember the matthew shepard case? he was at a bar and 2 guys offered him a ride home and then they beat and killed him! so yes people do randomly beat people they dont know cause they are gay..your comment sickens me..no im not gay but i dont think your the one to be judging how people live and feel.. people who think like you are the reason this country is as hateful as it is...

Hate crime laws are a crock. This was a case of assault. Why should somebody get more time, Just because this guy is gay? It sets up to many different standards. A crime is a crime.

anybody gets beat up, somebody didn't like them (hated). So now i guess everybody that gets beat up we need to pass a special law just for that situation. what a crock.

It's wrong to beat someone because they are gay but as far as I'm concerned, all crime is hate crime. I don't see why we need special laws for it. I hope the victim has a full recovery soon.
