NEWPORT, Ky. (AP) -- The superintendent of Newport Independent Schools has asked the Kentucky Supreme Court to decide whether he can continue to live in Ohio.

Michael Brandt, who is the former superintendent of Cincinnati Public Schools, has been in charge of the school system in Northern Kentucky since 2004.

The Kentucky Court of Appeals last month upheld a July 2008 ruling by Campbell County Circuit Court saying Brandt is in violation is Kentucky law by living out of state.

Brandt says he considers the appeal a "friendly case." He says although he lives only 12 minutes away from his office, he will move to Kentucky if that is what he has to do.
