Court: Comair Can't Sue Airport Over Crash

FRANKFORT, Ky. (AP) -- The Kentucky Supreme Court has ruled Lexington's airport may not be sued for damages stemming from a 2006 Comair plane crash that killed 49 people.

In a 7-0 opinion released Thursday, justices ruled that the Lexington airport corporation and its governing board enjoy the same sovereign immunity as state government does. The decision upholds a Fayette County judge's previous ruling that Blue Grass Airport can't be sued.

The airline had argued that the airport was in part responsible for the crash for not adequately notifying pilots of a construction project that diverted planes on the taxiway. The Comair jet took off in early morning darkness from a runway that was too short.
