HAMILTON TWP., Ohio -- The Warren County prosecutor's office will not pursue criminal charges against a former Hamilton Township fiscal officer.
The announcement came Thursday from the office of country prosecutor David P. Fornshell.
The township had requested that Fornshell investigate Jackie Terwilleger for possible criminal charges relating to her alleged backdating of checks, unauthorized use of a trustee’s signature and improper deferred compensation payments.
Earlier Thursday, Fornshell formally notified the Hamilton Township Board of Trustees of the completion of his investigation in a letter to Warren Ritchie, the township’s law director.
“Although BCI’s investigation demonstrates that Mrs. Terwilleger was grossly incompetent in her handling of the township’s finances, I do not believe there is sufficient evidence of criminal intent on her part to support criminal charges being pursued against her as to any of the referred issues."
Fornshell enlisted the assistance of the Ohio Bureau of Criminal Investigation (BCI) due to a potential conflict of interest with the Hamilton Township Police Department investigating the case.
The prosecutor also wrote that he expects the state auditor will ask Terwilleger to pay back $6,834.75, the amount of "overpayments she made to Deferred Comp. from 2011 to 2014, but which were not deducted from her payroll.”
Terwilleger resigned her position as the township’s fiscal officer in March 2014.
