LEBANON, Ohio - A four-day trial came to a close Thursday when a Warren County jury found a local man guilty of shaking and severely injuring his girlfriend's 2-year-old son.
The jury found Jason Milby, 30, guilty of felonious assault and child endangering and then-Judge Robert Peeler immediately sentenced Milby to eight years in prison.
The sentence imposed was the maximum allowable for the crimes committed, according to a press release.
In June 2012, the original case against Milby resulted in a mistrial.
Thursday's events bring to a close a process that began on June 14, 2011 when Milby inflicted what prosecutors referred to as "traumatic brain injury" to the son of his girlfriend while he was babysitting. The result of the incident inside Milby's girlfriend's home in Springboro left her young son in a permanent vegetative state.
According to a press release from the district attorney's office, "medical evidence produced at trial proved the victim was either shaken, shaken with an impact, or injured through some combination of both mechanisms."
Warren County Prosecutor David Fornshell was satisfied with the verdict and sentence.
"I agree with the judge that this man's violent conduct essentially took the young victim's life away from him. Justice was eventually served in this case," he said.
