39 local schools in violation of state law on safety plans, AG says

CINCINNATI -- Thirty-nine local schools are in violation of Ohio law for not submitting complete, up-to-date safety plans, according to a list released by the Attorney General's Office Wednesday.

Ohio law requires the board of education of each city, exempted village and school district to file a "comprehensive school safety plan and floor plan for each school building under the board's or governing authority's control."

This requirement includes chartered nonpublic schools as well.

Schools must update safety plans once every three years and whenever a "major modification to the building requires changes in the procedures outlined in the plan," according to the Attorney General's website.

The information would be made available to law enforcement in the event of a school shooting, fire, bomb threat or other emergency.

Fairfield City Schools Spokesperson Gina Gentry-Fletcher took issue with the Attorney General's information, which said the school district last filed their safety plan Aug. 17, 2010. By law they would only be three business days late for submitting an updated plan.

"We received a letter dated Sept. 1, 2010 stating that we were compliant. Because of this letter, we believed that our plan would not be due until Sept. 1 of this year," said Gentry-Fletcher.
"The school district submitted it's crisis plan, floor plans of all schools and evac locatons...at 4:15 this [Wednesday] afternoon. We want our community, students and staff to know that we take their safety very seriously."

Pauletta Crowley, Director of Community and Student Services with Northwest Local Schools, said local police and fire departments received current safety plans in December, but because of an oversight no one ever submitted the plans to the state.

"We send our [safety and floor plan] up [to the Attorney General's Office] every year. I oversee it. There's a mistake somewhere," Crowley said.

Crowley said the safety plan is in the mail, on it's way to the Columbus AG's office.

Dr. Mimi Webb, superintendent of St. Bernard-Elmwood Place City Schools, said the schools contacted the state Wednesday morning and "the problem is rectified."

But the AG's office said it had no safety plan for Elmwood Place Elementary, and an outdated plan for St. Bernard Elementary School. AG records show St. Bernard's safety plan was filed more than five years ago, two years passed the state deadline for re-filing.

School officials with Mt. Healthy City and Blanchester said they're submitting their safety plans after being notified by 9 On Your Side.
