Cheryl McCafferty case: Judge rules no grounds for new trial

FORT THOMAS, Ky. – A judge has determined Cheryl McCafferty has no grounds for a new trial in the 2007 shooting death of her husband.

McCafferty appeared before Special Judge Robert McGinnis last week in Campbell County Circuit Court. McCafferty’s defense argued she received an ineffectual defense in her original trial that resulted in an 18-year conviction for killing Robert McCafferty in the couple's Fort Thomas home.

McGinnis ruled McCafferty’s defense was adequate in his decision.

McCafferty admitted to killing her 44-year-old husband while he slept in his bed. She said she had no choice but to shoot him on June 25, 2007, because her husband had beaten her, fired a gun at her head and threatened to kill their son and daughter after learning McCafferty had contacted a divorce lawyer.
