CINCINNATI - A Westwood man will spend at least 15 years in prison for killing his 2-year-old son more than a year ago.
Judge John Andrew West sentenced 30-year-old Antrone Smith to 15 years to life behind bars during his hearing Tuesday morning. In March, a jury found the father guilty of felonious assault and the murder of his son, DeMarcus Jackson.
Police say on Oct. 21, 2011, Smith called 911 to report a medical emergency at his Westwood home. Crews arrived and transported injured Jackson to an area hospital where he died one day later from blunt force trauma to the abdomen, according to reports.
Jackson had extensive injuries including contusions to his jaw, eye, legs, arms and midsection when he arrived at the hospital, said Hamilton County Prosecutor Joe Deters. Jackson also had lacerations on his genital area, his neck, ear and buttocks, he added.
The child had been in foster care for most of his life before being returned to his biological parents.
Demarcus Jackson's foster mother Latasha Tye spoke during the sentencing hearing.
"This will never be justice because we can never bring him back but I can't hate you because I was instilled with God a long time ago... So I have to forgive you and still try to continue to love you because I love them babies and I still love them," said Tye before the judge handed down the sentence.
Smith remained quiet during most of the proceeding. He did tell the court he was sorry for what happened. He listened intently as Tye spoke to him.
"I wake up crying everyday and go to sleep crying thinking about this baby because he wasn't nothing but love. The only time I ever felt that baby hurt or cry was when I brought him to you," Tye said.
In March, the jury found that Smith was not guilty of aggravated murder, which did not make Smith eligible for the death penalty.
Smith's attorneys say they will appeal the conviction.
