LEBANON, Ohio - Ryan Widmer's defense filed a notice of appeal Wednesday, a weekafter a judge denied his request for a fourth trial.

The paperwork came in near the close of business onWednesday.

His defense told 9 News they planned to file the appeal to coverlast week's decision that he will not get a fourth trial due tojuror misconduct, but it is also an appeal of the trial and themotion his defense attorneys filed to find him not guilty and issuea judgement of acquittal.

In his third trial, Widmer was convicted in February ofmurdering his wife, Sarah, in their Hamilton Township home in2008.

Widmer, 30, was convicted of killing his wife of four months inhis first trial. However, that conviction was thrown out due tojuror misconduct. The second trial ended in a hung jury.

He is currently serving 15 years to life in a prison in Orient,Ohio near Columbus.
