ELSMERE, Ky. - A lawsuit has been filed in connection to a fatal officer-involved shooting in Elsmere.
Eric Deters filed a lawsuit Monday on behalf of Don and Tina Godawa, parents of Michael Godawa, 22, who was shot and killed during an altercation with an officer in June.
Michael and Elsmere police officer David Byrd got into the altercation in the parking lot of the Finish Line Bar on Dixie Highway around 1:30 a.m. on June 23.
During the contact, a shot was fired from the officer's gun. Godawa then fled the scene in a vehicle and struck a utility pole at Lytle Avenue and Dixie Highway.
The vehicle continued north, stopping at Main Street and Dixie Highway.
Godawa was transported to University Hospital where he was pronounced dead.
Terry Daly, spokesman for the Hamilton County Coroner's Office, said Godawa, died from the gunshot wound to his chest.
Byrd received minor injuries during the altercation and was transported to St. Elizabeth Edgewood where he was treated and released.
Deters claims there was no basis for the officer to shoot and kill Michael.
The Elsmere Police Department has not yet been reached for comment on the lawsuit.
